Abstract
The article intends to answer the question of the foun- dation of Human Rights. To this issue, it uses the mediation of ethics, considering this dimension of human action and under- standing of the world as a source of humanity and correspond- ing rights. In this context, however, the diversity of substantive proposals imply a critical analysis. Through this analysis, it is per- ceived that the ethical issue takes us beyond the right, in the strict sense, opening the possibility of a dimension of gratuitous- ness and of unconditionality previous to the ethics. It is in this dimension that the experience of love is inserted, as a possible human “right” not subject to precepts. It is precisely in this field that the excess evoked allows us to establish a relationship with the theological dimension and, at the same time, to identify a possible connection between Human Rights and theology.
