Abstract
In the context of private enforcement of competition law, actions for dama- ges based on infringements of competition law brought by claimants located at different levels of the production or distribution chain pose specific procedural problems in terms of consistency between judicial decisions, which can generate potential negative results, such as overcompen- sation of damages or failure to compensate the injured parties. To guarantee judicial coherence, the law provides that the court may resort to certain procedural mechanisms to avoid such undesirable results.
