A saúde e segurança no novo regime do teletrabalho: reflexões sobre o “sentido mais favorável aos trabalhadores”

Research output: Contribution to journalArticle

Abstract

The new telework regime has introduced significant changes regarding the health and safety of teleworkers. Besides the prohibition of certain activities, particular attention to certain occupational risks is required, and the periodicity of the obligation of health surveillance is reinforced. Legislation also provides for a duty of the employer to endeavour to reduce the isolation of the worker and to promote in-person contacts, besides a more general duty to refrain from contacts during rest periods. However, the legislator may have been influenced by a recent experience of "compul-
sory" telework, which in our opinion is not the adequate model to the reflexion and construction of a legal framework for a consensual or voluntary telework regime. Thus, we believe that the legislative intervention may have been overprotective.
