Abstract
The implementation of the declaration of unconstitutionality to the case involves the consideration of two rule effects: retroactivity and reinstate the revoked rules. The scope of the retroactive effect does not determine the inexistence of the acts performed under the auspices of the rule declared unconstitutional but rather its illicitness. The legal certainty and security imply a full reading of constitutional norms and constitutionally protected values and the overall consideration of the legal system.
