Abstract

During the Covid-19 pandemic, states adopted various restrictive trade measures under the pretext of public health. Early on, the European Union tried to contain such measures, even between member states, by adopting centralized measures. Although the Implementing Regulation (EU) that established the export authorization regime for exportation of personal protective equipment and vaccines comply with European Union law and WTO rules, more specifically, the General Agreement on Tariffs and Trade (GATT), which allow for a wide possibility of economic restrictions, this must be re-examined in light of a new concept of international solidarity.
