Abstract
This text comments on a decision of the Portuguese Court of Appeal of Guimarães about the legality of a resolution of demerger of a baldio (type of common land) taken by some of the commoners. The discussion of the feasibility of such demerger gives opportunity to revisit the concept of baldio itself.
