Abstract

Child and adolescent delinquency is a subject that has undergone several mutations over time. For many years, legal doctrine has questioned whether holders of parental responsibility should be held liable for the acts committed by their children, and this liability can operate at the level of criminal and/or civil law. The issue is not peaceful today, and the debate on it must be resumed in view of the growth of juvenile delinquency in recent years. In order to demand such criminal liability, it will be necessary to analyse the disadvantages and problems that it entails, from the point of view of criminal policy, as well as the implementation of its assumptions – first of all, the existence of a duty to educate and its corresponding omission, the determination and proof of the guilt of the parents and the harmonisation with the principle of non-transferability of penalties.
