Abstract

Is there any need for competition protection between the contract award and the con-tractual signature? Is such protection necessary now that the co-contractor has already been chosen? The analysis focuses on the compliance or non-compliance with the suc-cessive acts of the contractor and the contracting authority related to the quali-fication documents, the provision of the guarantee, the confirmation of commitments, possible adjustments, and the conclusion of the contract. It addresses mainly practical questions, in particular award expiration. The fundamental issue is to reflect upon how the competition principle is still a central value of the procedure, now, post-award.
