Abstract
Considering the sexual crimes development in the sense of the protection of the sexual freedom and the freedom of minor’s personal development in the sexual area, the danger of the grooming to these legal interests and the Lanzarote Convention and the 2011/93/EU Directive injunctions, it was necessary to introduce changes in the Penal Code. However, the 176º A isn’t properly articulated with the 176º, neither with 172º and 173º; in the existing legal framework it could happen to have a punishment for the grooming but not for the sexual acts perpetrated. Some changes are suggested to increase the coherence of the system and to protect the free development of minor’s personality in the sexual domain.
