Abstract
Article 60º of the Portuguese Copyright Law allows for any modifications in the architectural work without the architect’s consent. It is only required to ask for the architect’s opinion on the modifications and these may be brought about even without his consent. The architect’s opinion is not mandatory and is only necessary to assure that the modifications are legal, not requiring indemnity. Once the modifications are applied without the consent of the architect, the only thing that can happen is that the architect may not be named as author if he renounces authorship or else an indemnity will be required. Perhaps this does not protect architects moral integrity an authenticity rights the way it should, and other more protective solutions would be preferable.
