Abstract

The principle of equality falls within an area of legislative overlap, being set out in article 2 of the TEU, constituting a foundational value that forms part of the axiological basis of the European Union. Enshrining universal values, this regulation aims to shape a European identity, where equality and non-discrimination underlies and densifies the idea of a Europe of unconditional respect for human rights. On the other hand, the European Union guarantees the fundamental right to asylum, with respect for the Geneva Convention and other European legislation, to all those who meet its requirements. Knowing whether women, in extreme circumstances, will be able to meet one of the requirements to obtain protection and reception from the Member State where they are located, constitutes the main objective of this work. To this end, the most relevant case law on the matter will be presented. We'll see how.
