Abstract

The present commentary intends to analyze the ruling from the Court of Justice of the European Union, case c- C-155/19 and C-156/19 Federazione Italiana Giuco Calcio (FIGC) and Consorzio Ge.Se.Av. S.carl/De Vellis Servizi Globali Srl. Therefore, in a first moment, this article aims to establishes, which are the requirements set out under the Directive 2014/24/EU for a given entity to qualify as a body governed by public law. In a second moment, with reference to the factuality of the concrete case, the present commentary will critically examine the ratio of the decision of the Court of Justice of the European Union to qualify or not FIGC as a body governed by public law.
