Fraude sexual: o patinho feio dos crimes sexuais?

Abstract

The offense of sexual fraud has a longstanding presence in Portuguese criminal law. Studying the historical evolution of this article, still enshrined in the Penal Code, is crucial to understanding its essence and the legislative journey leading to the current legal provision. The restriction of the offense of sexual fraud, as set forth in Article 167, to fraudulently exploiting an error concerning the personal identity of the agent has rendered its practical application almost negligible. Broadening its scope, together with a more proportionate penalty, could revitalize this often-overlooked legal provision, despite its latent potential to safeguard sexual freedom.
