Abstract

The right to enjoy rest periods and leisure time is acknowledged and recognized in international and constitutional law. Evidences show, however, that most Portuguese work or remain available to work in rest periods, namely by using means of electronic communications. Professional disconnection is therefore advanced to ensure that, during these periods, workers may not be asked to respond to work demands or solicitations, including by means of electronic communications. European legislator, however, has not contemplated the right to disconnect, but has reinforced the work-life balance mechanisms as well as transparency in working relations.
