Abstract

Recent rulings of the Court of Justice of the European Union have shown how difficult it is to distinguish between the individual and the collective consequences of a transfer of undertaking. Moreover they show that the Court is increasingly concerned with the protection of the negative freedom to associate of the transferee, as well as with his/her contractual freedom and the freedom to conduct a business.
