Abstract

This article analyzes the KlimaSeniorinnen and, incidentally, Duarte Agostinho judgments, both delivered by the European Court of Human Rights (ECtHR), in which the Court ruled, for the first time, on the impact of climate change on the effective enjoyment of human rights. To this end, this article assesses how the ECtHR endorsed the existence of a positive obligation, derived from Article 8 of the European Convention on Human Rights (ECHR), to adopt and implement a regulatory framework aimed at reducing greenhouse gas emissions from within the territory and jurisdiction of the State – which also implies analyzing the concept of extraterritorial jurisdiction espoused in the Duarte Agostinho ruling. On the other hand, this article assesses the ECtHR’s interpretation of the victim status and the legal standing of individuals and associations pursuant to Article 34 of the ECHR. Finally, this article assesses the complexity of implementing the KlimaSeniorinnen ruling, first and foremost because climate change judgments test the limits of the principles of subsidiarity, separation of powers, and States’ margin of appreciation.
