Abstract

The European Union is facing a shift of paradigm in what concerns cyberspace. Several EU member-states have sought to prosecute presumed illegal activities, mainly related to file-sharing communities violating principles of intellectual property law, basing their initiatives on the fight against cross border cybernetic crime. The European Court of Justice, in its recent rulings, reflects on the boundaries of Fundamental Rights as they were understood until so far. The present essay attempts to reflect on the harmonization and coordination of the various rights at issue - and at stake – as well as to summarize briefly the state of the discussion.
