Abstract

This article attempts to answer the question as to what legal and political implications the decision of the 45th President Donald Trump to recognise Jerusalem as the capital of the State of Israel has had and will have, not only in the context of the status of the divided city, but also the Middle East conflict and the situation in the region. As the institution of recognition (and non-recognition) is one of the most interesting concepts of international law, the second part - after the introduction - of the article will be devoted to that. The discussion on the recognition of Jerusalem is impossible without an analysis of the city's status under international law. And although it did not begin with the United Nations' announcement of the Partition Plan in 1947, given the constraints of the nature of the publication, that year will be the starting point for further analysis. Part four will trace US policy towards Jerusalem with particular reference to the context of the Middle East conflict. The final part will deal with the presidential proclamation of December 6th, 2017 and its political and legal implications. The paper combines theoretical considerations (analysis of recognition under international law and US law) together with a case study of the actions of the US administration (primarily under President Donald Trump) towards Jerusalem.(original abstract)
