Abstract

The present paper concerns the time limit in Portuguese Law for challenging non-dismissal disciplinary measures within the employment relationship. The Law only establishes a specific deadline for employees to contest the most severe disciplinary measure, namely, dismissal for subjective just cause. Faced with this legal loophole, previous court de- cisions and legal writings have presented various solutions regarding the duration and calculation of the deadline. This study evaluates proposed approaches, considering conflicting interests within employment relation- ships and explores the interpretative limitations faced by the court when determining the mentioned time limit.
