Abstract

Integrity, accountability, and transparency are key factors to consider when avoiding passive or active corruption. The new technologies associated with brain manipulation or with the use of brain activity – brain-machine interfaces – have a potential for business estimated in 1.24 billion euros up to 2020. These technologies are particularly susceptible to hacking by third parties because brain manipulation through such devices may allow extracting information or biasing the user to perform a particular action without its knowledge or consent, therefore potentiating unfair advantage and abuse of power. The present study is relevant for the fields of Law and Public Health and is aimed at: 1) describing the main components and variables interfering with brain- machine interfaces operation, 2) describe how each of these components may be subject to abuse of power by third parties, and 3) make objective recommendations to reduce situations associated with unfair advantage and abuse of power when using brain-machine interfaces.
