Abstract
This paper clarifies the scope and cultural import of the distinction between genetic and functional synallagma, as it appears in German- and Portuguese-language private law literature. The distinction is queried against the background of contemporary private law, where the opposition between initial and subsequent failures to perform has been criticized.
