Abstract

The role of EU law in defending fundamental social rights in the context of the financial crisis was clearly disappointing. This protection was taken on by the European Social Charter and the European Committee of Social Rights (Council of Europe). The pursuit for social convergence came about with the approval of the European Pillar of Social Rights. Despite the initial scepticism regarding the Pillar, it ended up leading, with surprising brevity, to the approval of two Directives. One was Directive (EU) 2019/1158 on work-life balance for parents and carers, which has the merit of unequivocally formalizing the link between work-life balance and gender equality in the workplace. In this paper, we will highlight some of the most relevant topics of the Directive and its impact on the Portuguese legal system.
