Abstract

The protection of persons with disabilities has been a growing concern both at national and cross-border levels. The legal frame-works concerning “incapable” adults are changing (which now also happens in the Portuguese legal system), international and European law has given significant incentive to the transformation of mentality and legislative standard and some jurisdictions are developing means of patrimonial protection based on autonomy and self-regulation. With the present brief presentation, it is intended to give a glimpse on the current legal status and the main lines that might permit the reception of new and improved caring mechanisms. Not ignoring the great importance of personal rights in this matter, the present intervention is focused on a useful and equal patrimonial management and administration.
