Abstract
The present study aims to analyse the way in which the right to collective bargaining is regulated among the most relevant instruments from the Council of Europe, the European Convention on Human Rights and the European Social Charter. Despite being recognised by both, the Charter concedes, by far, a more generous frame. Nevertheless, the Charter remains virtually ignored by national and international authorities. And it is precisely in times of crisis that the Charter may contribute in a decisive manner to the effective protection of fundamental rights in the European context. It is, therefore, urgent to confer more visibility to the Charter and, even more, to ensure it a more relevant position among the European system of fundamental rights, in order to achieve these objectives.
