Abstract

The following paper seeks to shed some light on the most recent developments concerning the interaction between international law and municipal law as far as fundamental rights are concerned. By resorting to the concept of legal pluralism and by integrating it with the nature of social constitutional rights, we will try to ascertain how does the Revised European Social Charter (RESC) produce effects within municipal legal and judicial orders. The diversity and interaction of different levels of jurisdiction poses the question of whether and how can a superior degree of protection contained in an international standard be enforced within the boundaries of a contracting State. In this context, the RESC can provide an example of a procedural integration of its content in the legal order of its contracting Parties.
