Abstract
In a globalising world, the future of commercial and financial law presents a number of existential challenges especially in the codified systems of private law This paper is directed towards that challenge in the Netherlands and to its nationalistic system thinking following its new codification of 1992 and puts the discussion in an historic perspective.
