Abstract
The movement towards deconstructing social paradigms related to gender and sex faces a significant challenge in the field of sport, raising legal issues that need to be addressed. This thesis reflects on the issue of discrimination based on gender identity in access to professional sports, exploring its legal, social, and ethical dimensions through the lenses of anti-discrimination, labor, and sports law. The study examines the systemic barriers that transgender individuals encounter in the labor field, particularly in the context of sports, with a focus on the current legal framework, as well as the regulations, policies and practices implemented by sports federations. The aim of this analysis is to explore the impact of eligibility requirements for male and female competitive categories on employment access and whether they can be legitimately justified as genuine occupational requirements, considering the specific rationale of the activity and the specialty of sports employment relations.| Date of Award | 23 Jul 2024 |
