Abstract

With the crisis, there was a branch of the Law that gained an important relief. The Bankruptcy Law. Therefore, the present dissertation aims at demonstrating which way creditors are trained in the situation of debtor in possession. We intend to raise and answer questions that this legal regime raises. We pay attention to the functions of the trustee, as well as his / her responsibility in case of non-compliance with his legal duties. Thus, we wish to show that, concerning to the protection of creditors, their defense mechanisms are severely limited, and it is also affected by the efficient work of the trustee. We also pay attention to foreign legal systems because these have influenced the CIRE (Portuguese Bankruptcy code), so, for that reason, we establish comparisons with them.
