Abstract

The following thesis aims to question the legal acceptability of clauses that limit the laboral freedom of sports practitioners with a special emphasis on anti-rival clauses. This thesis goal is to critically reflect on the correspondence between legal norms and everyday experience. Considering this is a theme that hasn’t been duly explored by doctrine and that’s nearly inexistent in jurisprudence, we have opted to confront the regime of contractual freedom limiting clauses present in the current labour code with the specific regime that labour contracts currently demand. We shall also analyse the full extension of the constitutional principle of freedom of labour and in which way constitutional norms defend the aforementioned principle.
