The criminal justice in Portugal has come to show itself fragile towards the new challenges that arise with the evolution and transformation of the society. Faced with the need to cope with the problems caused by the increase of the already high level of criminality and organized crime, and in consideration of the already slow procedural pace of justice, the discussion resurfaces about the possibility to follow the European and International patterns in the way of negotiated justice. One of the institutes that is at the heart of the issue and appears as a solution to fight this loophole is the institute of DELAÇÃO PREMIADA. That being said, the current dissertation approaches issues such as the (in)compatibility of DELAÇÃO PREMIADA with the Portuguese criminal procedure and the (im)possibility to resort to this institute in a way to overcome some weaknesses in our system, by opting to follow a consensus and logical opportunity on behalf of a more swift and efficient justice.
