By the time of the contract completion, not all the possible constraints that parties may face when performing their services are previsible. A great example of this inevitable lack of predictability is the pandemic, which, since 2019 has been plaguing the country and the world, and has brought important and significative restrictions to the free will of people and goods, disturbing the balance of the most varied types of contracts. The current situation reminds us about the importance of the legal regime established to try to solve the disruptions that may emerge on the initial contractual provision, which is why we propose to reflect on the legal treatment determined for the situations of true impossibility of performance, in contrast to the much questioned difficultas praestandi.
