Abstract

This dissertation aims to analyze the general panorama of the effects of the declaration of insolvency on the franchise contract that has not yet been fulfilled. For this purpose, we will start this journey through the study of the legal regime applicable to franchise contract which, due to its atypicality, requires the search for a regime whose rules can be applied to it. Subsequently, we will analyze the effects of the declaration of insolvency in this contract, in light of our insolvency law. Last, but not least, we will tackle the legal consequences that may arise from the termination of the franchise agreement due to the insolvency of one of the parties.
