Abstract

Over the centuries, there has been a growing debate regarding the role of the State, both in terms of the economy and in terms of caring for its citizens, offering social protection. In this context, we find the role of the so-called Welfare State, which was fundamental in the post-2nd World War, emerging as a way of mitigating the effects of a more fierce capitalism, in fact, maintaining market freedom, but at the same time protecting citizens in situations of need, not simply leaving them subject to the law of the market and the most radical and impersonal capitalism. In this way, the role of the State itself is also discussed with regard to the eventual assumption of responsibility for damages resulting from work accidents, therefore questioning whether we should be here in situations of social responsibility, in which the State should intervene, or if we will only be faced with situations of private responsibility, in which the private should assume the loss in question at stake. In view of the above, we intend to address the various controversial aspects, with a special focus on that established by the Portuguese Legal System, namely taking into account the applicable principles, comparing them with Angolan Law and analyzing whether we should be facing situations of pure and exclusive private accountability.
