The purpose of this master’s thesis is to analyse the presumption of dismissal’s acceptance, as well as the respective elision, provided for in article 366 of the Labour Code. Paragraphs 4 and 5 of the referred above article have given rise to different positions among the Doctrine and Case Law, for which reason we propose to analyse each one of them and, subsequently, to take a position on this issue. This is a subject which has an impact on the reality of Employees, so it seems to us that such legal uncertainty should be avoided.
