Abstract
The purpose of the present master's dissertation is to carry out a legal, doctrinal and jurisprudential analysis of the presumption of acceptance of collective dismissal based on the acceptance of compensation. Our analysis follows a diachronic perspective, addressing the evolution of the treatment given to the relevant regime in its various versions. The issue is dealt with from a critical point of view, considering the legal assets involved and the workers' rights jeopardised by the regime under study. It also seeks to contribute to clarifying practical issues that have arisen, particularly in view of the most recent developments in the jurisprudential understanding of the regime alluded to| Date of Award | 4 Sept 2025 |
