Compliance has established itself as an essential tool in preventing corruption and all kinds of crime in Portugal. It has been promoted by the National Anti-Corruption Strategy, through the General Regime for the Prevention of Corruption, and Law No. 94/2021. This study aims to analyze the origins of the regulatory compliance movement based on regulated self-regulation at international and national levels. To this end, we conducted a literature review and legislative analysis to identify challenges and point out possible solutions. We conclude that there are some inconsistencies in the wording and implementation of legislation on regulatory compliance. Challenges such as window dressing and the privatization of criminal investigations require improved regulation. The effectiveness of compliance in Portugal will depend on legislative adjustments that promote an ethical culture and guarantee legal certainty for companies, strengthening the fight against crime within legal entities.
