Abstract
The present master thesis questions the presence of the requirements of specialprevention, inherent to the enactment of any sentence, in sentences imposed on the elderly people. The increase in the number of elderly people in prisons leads us to wonder to what extent it is justifiable to give an elderly person a prison sentence, whether he or she meets the necessary requirements for a sentence, and whether there are other alternatives that can be considered. According to the previously stated, we try to understand how the perspectives of reeducation and social reintegration work when aimed at an elderly people inmate and if
there is a real practicality to them. In short, given the sentences that are handed down to the elderly people, there seems to be a need for a readjustment in the way sentences are handed down to the elderly and, consequently, in the activities and programs directed at elderly people inmates.
