The demographic ageing in Portugal is associated to the criminal phenomenon of abuse against the elderly. Although silent and often hidden, it constitutes an intolerable violation of the human rights and it translates into a violation of the elders’ dignity, as they already are in a position of noticeable vulnerability and incapacity. This form of abuse may take place in the family setting, so it becomes even more important to protect the elderly, since they stand fragile in relation to the individual responsible for their health, integrity and well-being. This is a specific situation, making it important to analyse in what terms these non-official caretakers can be held accountable for elder abuse in the light of our Penal Code. Is our Juridical Ordinance sufficient in protecting this age group, as it grows in representation in our society? And will this be effective in holding infringing conduct liable?
