The protection of parenthood, especially in the most recent years, has proven to be one of the fundamental pillars targeted by the Portuguese State, as well as by organizations such as the European Union, the United Nations, and the International Labour Organization. Acknowledging that all rights enshrined in national legislation, particularly in the Portuguese Labour Code, are worthy of reflection, the choice made was to focus this analysis on the protection afforded to pregnant, postpartum or breastfeeding workers and to workers on parental leave regarding dismissal. To this end, an investigation was conducted into the main issues surrounding article 63 of the Portuguese Labour Code, with particular emphasis on the discussions regarding the necessary prior consultation with the Commission for Equality in the Workplace and Employment, the competent organization for verifying the occurrence of discriminatory situations. Simultaneously, in order to understand some of the legislation choices made, we aim to demonstrate the evolution of the protection of this category of workers in both national and international legal frameworks.
