Abstract
The right to data protection has been strongly established as a fundamental right from a European perspective. However, technological advances have presented significant challenges to the effective protection of European data subjects, especially in the transfer of personal data to countries with lower standards of protection than those established in the Union. In this context, we study the evolution of European law, as opposed to US law; the challenges of mechanisms to guarantee protection in transfers to the United States.
