Abstract

This article aims to answer the question of whether or not consumers who purchase goods not in conformity with the contract are subject to a hierarchy in the exercise of the rights made available to them by law. We will analyze the sale of consumer goods regulation, as set out in DL 67/2003, as well as Directive 1999/44/EU, which it transposed, and critically address the various academic and case law views in order to find the answer that we believe best reflects the spirit of the legislator.
