The core of this dissertation is the analysis of the transposition of the Directive (EU) 2019/1937 of the European Parliament and of the Council of 23rd October 2019 into the Portuguese legal system (Law n. º 93/2021, of 20th December) and the questions it may raise. Faced with the worker’s knowledge of the practice of an illegal act by the employer, the worker is confronted with the dilemma of denouncing the facts committed and, simultaneously, reconciling such denunciation with his labour duties. For this reason, there is an urgent need for whistleblower protection mechanisms and for privacy guarantees, including the anonymity of the report, along the entire line it covers, if this reflects the will of the whistleblower.
