This study analyzes the physician–patient privilege in our legal system, legal and deontological duty to which all doctors and health professionals are subordinate, their legal substantiation and the typical elements of this crime, fixed in article 195.º of CP. Through the various doctrinal conceptions, we have analyzed the situations of conflict with which the physician may face and which emerge from the other duties to which the physician is subject. The reference of domestic violence in the area of physician-patient comes up in this study, from the need to address an issue that in today's society has become a phenomenon of difficult control and where the doctor can play an essential role.
