This essay concerns the conciliation between the obligations resulting from the contract of employment and the Rights, Freedoms and Guarantees of the worker as a citizen and, in sequence, the problem of the relevance of the extra work behavior and in what terms it may constitute dismissal. After such analysis, we will distinguish the regular work contract and the “tendency worker”.
