Over the last decades, scientific and technological innovation has marked society across the board and the medical field is no exception. Cisely, facing the new challenges posed by the union of artificial intelligence and robotics with medicine, Law has the important role of making this new reality compatible with the institute of civil liability, in order to ensure legal safety and trust. As a result, this dissertation aims to reflect on some legal issues that result from the impact of robotic surgery, with particular relevance to the attribution of liability arising from damage caused by surgical robots, considering not only the possibility of subsuming this new reality to existing legal norms and institutes, but also the possibility of accepting the attribution of legal personality to autonomous robots.
