The issue of non-contractual civil liability of the state and other public entities is, today, of singular relevance, largely thanks to the collapses recently experienced in the Portuguese banking sector. This text aims to offer a general theoretical understanding on the theme of non-contractual civil liability of regulatory entities – in particular, those of the financial sector – through the study of the legislation that regulates the non-contractual civil liability of the state and other public entities. It is intended, above all, to offer a critical perspective of the legal regime, questioning the goodness of some of the solutions, as well as explaining doctrinal divergences that are felt concerning different aspects.
