A responsabilidade dos gerentes e administradores pela apresentação indevida da sociedade à insolvência

Abstract

The economic crisis, companies’ insolvency and the disappearance of economic agents from the market translates into a dangerous risk for the economic sector. Henceforth, an urgent need emerges to hold liable those who have created or contributed in some way to the situation. It is in this context that, there is now widespread skepticism of managers’ and administrators’ actions of inadequality submitting insolvency of the companies. In order to provide answers to several questions generated from the 22nd Article of the Portuguese Insolvency Code (CIRE), we developed a way that begins with the determination of the insolvency situation, which goes through the administrators’ duties and ends with the clearance of their responsibility.
