Abstract

In this paper about fraudulent and negligent insolvency crimes, we analyse typical objective and subjective elements as well as the existence of objective condition of punishability. We take position about the several doctrinal divergences. The major difficulty was the inexistence of a deep investigation on the more specialized doctrine. We hope this paper may contribute for a fundamental connection of two areas – insolvency and penal – for the exact understanding of these two crimes.
