Abstract
In the Portuguese Civil Code, the legislator used abstract and indeterminate concepts in order to regulate a multiplicity of concrete situations of Tort Law. Due to this legislative option, it is discussed which are the necessary requirements for the loss of use to be considered a damage and, consequently, compensable. The main purpose of this dissertation is to answer this question through a jurisprudential analysis of the subject, more specifically in relation to immovable property.| Date of Award | 4 Dec 2024 |
