This dissertation focuses on a particular scenario of tension between Intellectual Property (Law) and Fundamental Rights, which is the case of the regime of trademark registration and how it can constitute an obstacle to the exercise of the fundamental right of freedom of expression. In fact, by prohibiting the registration of trademarks with a potentially offensive or immoral content or that use symbols with a high symbolic value, trademark law is limiting individuals' freedom of expression. Thus, this paper aims at presenting the content of the trademark rights, which commences with the registration, the limits to freedom of expression in general, as well as the instances of conflicts between these realities, in order to conclude whether this tension is well resolve, i.e., if the trademark regime can, in fact, constitute a legitimate obstacle to freedom of expression.
